Hi,
My H1(second term) expires in December 2009. I was out of the US for more than a year and resumed my job in jun 09. My employer will be filing for H1 extension in October 09.
I have an approved I-140.
If my H1 extension gets rejected, will that affect my green card process ? If H1 extension gets rejected and if I switch to EAD, will the H1 rejection affect green card processing ?
Please Help.

Hi,
My 6 yr H1B expires Dec 15,2009. I had applied for labor in 2008 and have received the case number for the labor dated June 26, 2008. My labor is not yet approved and online the status shows "pending". The company has not got any RFE against the labor. I dont know why its taking so much time. My main concern is, Can I apply for h1B extension on the basis of "Pending" Labor approval. What is the time frame to apply for an H1B extension? How long is the extension granted for ? 1 yr or 3 yrs....
Please advise ....

FP done in Nov 2007. Planning a trip to India in Dec 2008 to Jan 2009. What if I receive biometrics during this time? After 1 year of FP, I anticipate that there would be repeat Biometrics done.
Is there a way for us to request Biometrics early? I am going to renew EAD and AP 4 months before expiry (expire in Nov 2008). Will this take care of Biometrics renewal as well?

U.S. Customs and Border Protection has announced new fees for persons seeking authorization to travel to the United States under the Visa Waiver Program. The authorization is obtained prior to travel through the Electronic System for Travel Authorization (ESTA), and typically remains valid for two years. Beginning on September 8, 2010, the ESTA travel authorization will require a valid credit card for payment of a $14.00 fee. The purpose of the fee is to finance efforts to promote international travel to the United States, and cover operational costs associated with running the ESTA program. Individuals who already possess ESTA authorization do not need to pay the fee until it is time for them to reapply.

My wife is on H4 currently (came into USA on H4). We are planning to apply for her H1 in April. Once it is approved, we are planning to to CANADA for H1 stamping.Her current H4 visa expired in 2006. I-797 is valid till May 2007.
How easy is to get new H1 stamping (from H4) in CANADA?
What issues you face?
She has a US masters Degree?

My daughter is on F1 visa since she turned 22 years. She has her AOS (employment based dependent on me) pending. I-140 cleared and I -485 filed before she turned 22 years. She has also received her EAD and AP based on pending AOS.
We are planning to go to Canada and she want to use AP for reentering USA. My question is:
1) Once she enter USA using AP what happens to her F-1 status? Can she continue her F-1 status?
Appreciate guidance from Gurus/ Lawyers.

Someone told me that I-140 have to be applied 45 days from PERM approval ? Otherwise PERM will get cancelled. Is that true. Can anyone help here.

Hi all,
Looks like our company is going to merge with another company in the next 2 weeks and the name is going to change ... I am not sure about Tax-id ....
I filed 485 during the July 2007 rush and had I-140 approved in May 2007. I am currently on H1 expiring in Sep 08 .. I sent the papers to the lawyer for extension last week with the current company's documents ... not sure if they applied yet ...
So my questions are:
a) Do I need to do an I-140 Amendment for sure ... (or) can I use AC-21
b) Any risks associated with I-140 Amendment? If something bad happens to the Amendment, Can I still use the priority date (Dec 2006) ...
c) Should I file for H1B Amendment also

Hi, I need your expertise, please help me. Following is my situation.
My EB3 labor priorty date was June 2003 was in pending, later same company filed in EB2 and I 140 got approved in Dec 2005.
I filed I 485 application in july 2007 and I applied in so hurry, I forgot to send a copy of I 140 approval as part of 485 filing. I got all the receipt notices.
My EB3 labor got approved before my 485 filing and I140 got approved this month
I would like to port the EB3 priority date. Please input your suggestions.

My wife came to the US on a H4. She got her H1 approval in October 07 and started working for the consulting firm that sponsered the H1. She also got a consulting position in a company. But her SSN was not issued until Jan 08. So the consulting company cannot gerenate payroll for Oct, Nov and Dec of 2007. We are planning to goto India in May and also get our Visas stamped. Any ideas on whether we will run into problems when we go for stamping, since she will not have a W2 for 07. Also will the paystubs from 2008 suffice at the consulate? Do we have to tell the consulate that she started working in Oct 07 or can we just say she started in Jan 08 will this create a problem of why did she not strat working as soon as her petition was approved in 07.
