I'm in the 8th year of H1-B, BEC priority date 04/2001, just got a notice that the case was closed ?? and the lawyer is working to reopen the case.
I have now a very good opportunity to work for another company, huge pay and benefits, a lot of pressure from this company to work for them.
Pls who can answer 2 small questions:
1. Do I have a chance to work for this company?
2. It makes a difference if I'm currently in NJ and this new company is in Utah - thinking that maybe they are not so many applicants in that state? Just for the LC processing speed?

Now a days VFS is not releasing appointment dates more than 2 - 2.5 weeks in advance. I am not aware of any specific time of the day when these become available.

Hi,
I am going back to India by next week. But my L1B extension is still pending (We applied for ext., before it expired and recieved RFE and responded. So as of now its more then 6 months from the date of I-94 expired and still my petition is in process).
My question is,
- while going back, do I need to show the copy of reciept in Port of Entry? (as I need to return my I-94 which is expired long back)
- Will it create any problem when I apply for extension again?
(My employer say, it shouldn't be a problem as I will have Approved/Denial notice which prove that I maintained legal status)
Or is it worth to wait here until I get the decision? (as I may cross 240 days by Jan, I am not sure whether the decision will come before that)...
Please adivce.

Hello
We moved to a new location after filing our 485, EAD and AP petitions. We immediately sent the AR11 forms (by Fedex) and also did the AR 11 form online. Apart from this we updated the addresses for all pending petitions.
The status is as follows:
1. My wife's EAD went to the old address and fortunately USPS forwarded to our new address. However my EAD has not yet reached me though when I check online it looks like it was approved on 1st Oct. How do we track this?
2. I have received the address change confirmations from USCIS for my 485 petition. I have not received the same for my wife and daughter's petitions. Do I have to go and update the address change once again online?
Kindly advice based on your experience.

Some big compromises in the House version that dropped this morning. First, there will be $2525 in filing fees, $525 of which is due at the outset and $2000 of which is paid five years in to the ten year conditional non-immigrant period. That should presumably answer critics who complain that DREAM will add to the deficity. Also, conditional status is granted in two five year terms and the college education/military service requirements must be met in the first five year term in order to get the extension approved. Hello Members,
I noticed that the dates on my i-765, i-131 and i-485 changed to 9/1/2008 today. This has not changed since I got my EAD. None of my wife's dates have changed. Does this mean anything? The things I have done lately that might (or might not) have caused this:
- Called CSR to check on status. She asked me to call back as my processing dates are not current yet.
- my lawyer sent G-28 so they could check on any information for me.
Here is some info:
i-140: 9/26/2005
i-485: 7/23/2007

My friend and his wife re-entered US on AP a couple of weeks ago....They were paroled into US till Apr 2009. Their APs are valid till Oct 2008. Now his wife needs to go back to her home country immediately for a while (not sure how long due to family emergency).... If she doesn't plan to return before her current AP expires, what are her options to re-enter. My friend is still on H1 status valid till 2010, no H1/H4 visa stamps.....If she intends to stay home longer, can she re-enter US on a H4 visa after getting it stamped...If she plans to return before her current AP expires, say in Sep 2008, is it safe to use AP because she will be out of the country for 5 months if she leaves now and we are not sure if someone can stay out of US for that long and re-enter on AP.....Any suggestions...His PD is April 2004 EB-3 India

I am working with a consulting company and my company filed for my GC in 2009 (PD is 25-Feb-2009). I received my I-140 approval on 28-Feb-2010. Now the client where I am working, has offered my a fulltime job and GC processing. I have received mutual consent from my current company for any legal issues. Now, if I join the new company and file my GC from there, can I port my Priority date for the new processing? Also, what should be the earliest joining date? What all other precautions should I take while filing GC with the new company?
I received the offer on 07/09 and have to give my decision by 07/15. I would appreciate if anyone can help.

6 months back my case was moved to New York (I am working in NY as a consultant ) regional center where I am working now.
I have to move to NCarolina this month end for a new assignment. What should I do now?
If I inform USCIS thru AR-11, how much time they take to transfer my case to new regional office? Worried if they take long time and dates retrogress before they transfer.
How early can I apply AR-11 and how late I must inform them?
Anybody with similar experiences? Pleas suggest me the due course of action.

I want to know the priority date in the approved I-140. But the employer is not giving me copy of I-140. I called USCIS and they say they cannot give the information to be.
How do i get my priority date now?
I have I-140 and I-485 receipt numbers.

The visa bulletin says "Effective Monday July 2, 2007 there will be no further authorizations inresponse to requests for Employment-based preference cases. All numbers available to these categories under the FY-2007 annual numerical limitation"
But doesnt that mean that no I485 authorizations will happen but filing can still be done and EAD received as de facto?
Please ask your respective lawyers to clarify this with USCICS/DOS.

Hello Attorney,
I have 6 months left on my H1B-I797 to expire. My visa on the passport got expired in 2007. I am planning to go to Tijuana, Mexico for stamping. I work for a financial company for past 4 years. I have approved I140.
Can you please advise if i can get the visa stamped? I have to visit India in May and hence cannot wait until the my H1B extension is filed and approved (based on my approved I140).
I am confused and worried that the consular officer may say that you have less than 6 months of validity on I797 and may deny the visa.
Can any one please advise?

When we file 485 AOS along with EAD & APL, these are three seperate forms, so we get three seperate receipt numbers?

Was on H4. Have an EAD now. Want to renew.
While renewing, on the form, there are 2 questions:
14 Current Immigration Status
15 Manner of Last Entry
(both seem to have the same answer)
Any idea .. what I need to fill here?
