I came to USA in July 1997. I did my masters here. I worked for 3 fortune 500 companies so far. I have been with one company since last 11 years. I am on EB3(mar 2003). I am a senior manager in fortune 50 company and on the path towards directorship. I wish I had green card, that didn't prevent me from having a good life and career. I brought an house 10 years ago. All I can see few more years of wait. Reg' Pappu post about action, the only action I can take is converting my case to EB2, which I tried several times within the company and it didn't work. The second action I can take is change employer. I have a good career, pay in this job, not sure if I would be able to get same one outside.

Please write to Sen.HILARY CLINTON expressing your dissatisfaction or concern with regard to failure of Sen.Cornyn Amendment. It's critical that we as Indians get her opinion on this issue. She voted NO on this amendment DESPITE the indian lobby contributing to her campaign. Also its likely that she might become our next president.
Obviously, Sen.Obama does not care much for Indians!

I got a email notification from my attorney just now that my I-140 is approved with priority date ported from EB3. Not sure whether I should wait few weeks before initiating interfiling process.

So they'll probably take out schedule A workers(Nurses etc.) from EB3 category
I am assuming that will be the end result. It means they will not be counted against any VISA CAP.

My application reached nebraska center on july 2nd at 9:01 am. no receipt number yet and checks not cashed yet. Is there a poll somewhere in these forums to see how many july 2 filers received receipt numbers?

A lot of EB3's got EAD's out of turn. They are the ones who have created the EB3 backlog and also EB2 backlog.
Stop pointing your dirty fingers at handful of EB3->EB2 converts!

Looking through the ammendments, one that stuck out was about the drunk driving conviction. The ammendment makes it a deportable crime. Well, not that we would ever be stupid enough to drink and drive. But, if you do, and you get caught, be aware of the serious implications it may have.

This link which is giving prediction for Oct, 2007 looks totally off to me.
if you see his EB3 predictions he is saying it will be close to to Jan 2007.
Where in Jan 2007 EB3 China was Aug 2002 not April 2005.
Don't know what is the reasoning behind these predictions.

How insane you are, you are giving the credit of that to USCIS ??? I think you were sleping when people had rallies in CA and IV had 'flowers to USCIS' campaign, how about Zoe Lofergn's threat, I'm sure you don't know any thing. USCIS shares most of the responsibility of you and I being on this forum. USCIS was doing a tardy job and wasting several thousand green card numbers every year that's why DOS had to push them by making the world wide dates current. And 'no' they did not 'realize' any mistake, they did not want to get into legal trouble and get publically exposed(Zoe Lofergn asked for emails and all communication regarding Visa cut off dates). So they took the shortest and safest way to get out

Either this personDard-E-Disco is either ignorant or doesn't know what he/she is talking about. I doubt if Dard-E-Disco knows how it would be for some one to wait 7 years for any immigration process and watch USCIS screw-up the FIFO process and how the customer service at USCIS is cannot differentiate between a RD and PD better than that I suggest this person to read the AMBUDeSMEN report if you don't what it is just google for it , after you read the report and recommendations come back and post your wise comments. You have to consider the scenario where both spouses have LC pending in PERM and BEC- and only one may have applied for 485. I'm just hoping people who have bought the LCs and tuned their work experience to suit available LC would be scrutinized strictly and would stay in I-140 stage longer.
Out of the 144k perm, FEW have 2 labors (1 in eb3 and another in eb2). Also many have labors in BEC as well as PERM (THIS IS QUITE A LOT). So the total real applicants combined from BEC and PERM could be around 200k. Not all the dependants (kids) need EAD. Not all the primary applicants apply for EAD. The total approximate EAD applicants could be 350K.
ALSO, ONE THING YOU HAVEN'T CONSIDERED...As the priority dates are unavailable until october and the expected slow movement of the 2008 bullettins(because they have the count of pending applicants now), there will be only very few EAD applicants in next few months. How ever, all these applicants will re-apply every year...they they can expect this same load until they provide a relief to issue visas to everybody.

Just a thought.
I think USCIS might be busy with approving I485 cases of EB2-India/China. From October it might be on track. For most of cases, approving I140 immediately is not going to help applicant as he has to wait for I485 as per priority date.
