Agree. I still blame name check 180 rule - a major decision by USCIS/FBI helped this backlogg to go from bad to worst.
Name check 180 rule -it allowed thousands of people from EB1 / EB2 Row to get their 485 cleared and consumed major chunk of 2008/09 EB visas. Had it been not there, many old timers, would have used visas as their Name check would have been cleared before them.
Oh yeah, I hear you; I personally know many of my ex-colleagues in a big IT sourcing company who came to US in L1A got their GC through EB1 category within a matter of 6-8 months.....last years 180 rule change does benefit most of these fortunate guys.....

hi i have come to the u.s. on a f2 visa and currently my spouse is doing her OPT.i applied for a driving licence in georgia and i was issued a learners permit based on my I94,visa and letter from social security office denying me a ssn.
i went to the same centre(decatur) for a road test and now they say that we cannot give you a licence because your visa says dependent for a student of wisconsin university,so you should go to wisconsin and get your licence.i went to another dmv centre and after verifying my docs. they let me take the road test and i cleared the test and they asked me to go to the counter to pay money , at that time the person in the counter again asked me for passpoert and i94 and he saw that university of wisconsin stuff on my visa and he said he will not issue a licence and i spoke to the supervisor and he says get a letter from INS ,i showed him my spouse opt card and showed him the words in the card which reads"eligible to work in u.s. upto ----").now he says that is your spouse opt card ,what autorisation do you have to stay in GA ?
has any one come across such a problem?is so kindly advice

I totally agree with "bsbawa10" , Not many people will involve if its a matter of spending 30-50$ and for sure stuff like Calculators and clock will go to the Kids of USCIS officers and their friends as Thanksgiving "Gifts". I think we should send mass letters to all the involved agencies with posters. Not only all the people will be involved, it will be difficult for USCIS to redirect the stuff to some orphanage/veterans Hospitals etc. Just my 2 cents.
Flower campaign had similar fate - 2 to 3 truck loads of flowers just went into hospital. it was more of Lofgren involvement that helped us.
We need to think with cool heads and execute things properly - first organize ourselves - gain support - consult our counsel - come out with proper plan of execution.

Dear XXXX,
This is to once again thank you for your continuous efforts in making things move in the legal immigration front.
We would request you to bring HR 5882 to the table and hence help people waiting for so long get immediate relief. We think this is the best time to do it as there are so many waiting in long queues for so long and are unable to buy houses though they are at rock bottom prices now, or change companies as some of us would also like to, and start new companies and jobs. There are very much needed in this time of economic crisis. Applicants in EB3 and EB2 Employment based greencard category are severly backlogged.
The problem is mainly due to country based quotas and wastage of many greencards due to administrative delays over the years, as you know. This can easily be fixed with a simple administrative action and need not need to be done as part of the bigger comprehensive immigration bill. We too need a change.
Below are some statistics and details of the problem, just in case you missed a point.
1. High technology H1-B visas allowed into US = 85,000 H1B per year.
2. H1B quota limit per country = None, quota limits.
3. Greencard eligible candidates = All H1B holders
4. Total Employment Greencards = 145,000 per year.
5. Quota limits for greencards = 7% per country and each family member is counted as 1 visa.
6. H1 holders from India = 30,000 to 40,000 per year.
7. Greencards available for India by quota limits = 2000 � 3000 per year.
8. People waiting in Queues = 37,000 � 38,000 per year.
9. Estimated wait = 10- 15 years per life.
10. Estimated loss of productivity = unlimited.
11. Loss of health and health related issues due to these worries = incalculable.
Consequences:
1. EB3 Employment based category from India is severely backlogged,
2. Number of applicants in Queues waiting to buy house = 300,000
3. Number of applicants in Queues buying a house now = 0.
4. Money spent by applicants on rent per year = $6 billion
5. Number of applicants having Citizen children born in US = 80%
6. Number of applicants unable to start own companies(as they are tied to employer all the time due to greencard sponsorship)
= 30-40%
7. Applicants disappointed and leaving US = 10-15%
8. Applicants planning to come back after retirement who take with them US Citizens who will sponsor them = everybody who is leaving US right now with Citizen kids
9. Burden on social security and healthcare by applicants in point 7 = billions of dollars.
10. Severe pain for everyone wasting time on worries and uncertainity.
11. Many people thinking of returning back, very disappointed.
Solution
Please provide immediate relief. We are still holding our bags in hands even after 5-10 years of playing it by law after applying for greencards. Please respect liberty and freedom and let that happen to legal applicants.
1. Please remove country quotas for greencards immediately to make waiting less for legal employer based EB2/EB3 applicants from India in long queues ALREADY in US for years.
2. This needs No new jobs or Visas. It�s just a simple fix to help bring joy to some legal immigrants and give them freedom to contribute more.
3. Please provide greencards for any legal employment based applicant who lived in US for atleast 5 years and is waiting for more than 5 years and paid taxes and live like a good American Citizen.
4. Please provide Citizenship for anyone who lived in US for 10 years and played by the rules all the time and paid taxes.
5. This will help people buy houses that are so cheap now which will pump in $40 billion even if 50% people buy houses.
6. Construction jobs increase as people start buying houses.
7. Manufacturing and auto industry improves as people start buying cars again due to renewed confidence. Else they continue to adjust with their old cars for now.
8. A fee of $1000-$3000 can be applied for premium processing which can generate $1.5 billion instantly.
9. Stop the distribution of 50000 diversity greencards lottery per year immediately. This is bad in the current times, when people are waiting in legal queues for ever.
10. Issue greencards immediately to anyone who did PhD in US and to Masters Students.. They will be more productive if you help here.
11. Please don�t wait for CIR to have these. This is a small admin fix, no new visas or jobs.
Please let us feel respected for playing by the rules. It will come back to the American people in full gratitude in the form of jobs and renewed vigor.
WE TOO NEED A CHANGE NOW.

And the situation prior to surge wasnt any better either. I remember in 2006, the PD for India EB3 was April 2001 and now its Nov 2001. :mad:

Completely Agree with you. Rather have some process than none.People in the forum are talking a lot about visa recapture..
But how will this help if USCIS continues to disregard PDs utterly and just approve cases that they can lay their hands on....
Due to July 2 fiasco, pretty much everyone have filed I-485...Even those with 2007 PDs.
Say USCIS recaptures Visas, makes every category current and starts approving 2007 PD cases! Even worst, due to the every category 'C', may be 2008, 2009 (when it arrives) people start applying I-485 as well, and USCIS continues to consume all the visa numbers to to approve the cases of these lucky bas*$%^&ds (no offence!) with most recent PDs. How does this help you or me with older PDs waitin for years and years ! :(

Just wanted to let you know that I received my refund yesterday. My wife and I filed a joint return. We both have SSN's. Just relax folks if you filed your taxes you will receive the refund. I had hoped the money could have been put to better use but oh well the politicians know better.

I've sent 7001 to Ombudsman , Contacted Congressional offices and ultimately filed a Service request in Nov 1st week. After all this NSC opened my case yesterday Dec 9th and the status changed to "RFE sent" - there you go ! They bought at least 2 months extra time.
What a bunch of jokers at NSC - my case was extremely straight forward :(

Common people. We desperately need atleast THIS campaign to be a success. I mean as a team the IV core CANNOT ask for an amount lesser than $5.00.
We are a member base of 30,000 members, cant we all contribute this once? It is exactly FIVE dollars that we ask of ALL members.
If we cannot get every single silent/dormant member to contribute atleast this once, then maybe we should just pack up our bags and fold, coz if we cant even contribute FIVE DOLLARS for our own betterment, we are in a very sorry state.

- tricked and lured by start-up in silicon valley. Abandoned everything and came to California in Jan, 2000 made the deadly mistake of not taking the copy of approved I-140 (I still slap myself every morning for that mistake ;) )
- Found out they have only one customer
- Founder wasted own 20 Million dollars but never increased the tally for the customer from 1
- "Startup" went under in 2002.
- Joined new company (the only customer of start-up) and filed labor in March, 2003 and enjoying every minute of it... :)

A Person cannot Travel before the AP gets Approved.If you do, means Abandoning your GC forever. Please be careful before you advise anyone on these critical issues.
If the person is on H1b, then he/she can travel without AP as long as they have an unexpired H1B visa and carry with them the I1485 receipt.
AP has nothing to do with your AOS processing. AP like EAD is for our convenience and has no bearing on the AOS process.
The only time it has is if someone uses the EAD /AP , then they are no longer on H1B.
As far as leaving the country without AP and then getting it mailed , there are mixed opinions (not facts). Some think it will come back to haunt you later and others think it is of no consequence.
I personally had a family member do this back in Oct but will keep this board updated if and when they have an issue.
This is just my opinion and take it with a grain of salt.
