I fully support this donor forum. there should be some incentive for members who donate. they are not doing it because they have lots of money to spare, but they sacrifice because they believe in this cause. I don't think $25 is going to break anyone's bank. Just sacrifice something that you consume/enjoy every week, and donate that.

as per you, your I-140 was never denied.
My I-140 was never denied. In fact the date 09/04/2007 that NSC mentions about the denial is the date that I got approval notice. I have the approval copy from USCIS. I am not sure what the adjudicating officer is looking on his terminal.

It is very easy to contradict or find errors.
No body is getting paid here to have a tester test it. Yes I like the idea of donor for paid members. There are 31000 members not even 2500 members are contributing. This is one way of making them pay for the services or the info you get from the forum.

It is April new numbers for the quarter will be available.My guess is EB2 I will move beyond April 1 2004.Once it crossess 2004 then it will be almost in 2006 not many cases in 2005.

A compassionate visa is immediately required for reasons of humanity and dignity. Currently, because of the technicalities of US immigration laws many families torn apart are also subject to more degrading treatment at times of severe illness. Any provision should allow for the following:
* US residents, including those who are landlocked, to leave the USA for any necessary period for compassionate reasons;
* Non-US residents to enter the USA for any necessary period for compassionate reasons on a nonimmigrant basis;

First, by its nature of being a derivative, a derivative beneficiary does not have an original application to speak of. Only the parent has a petition, which has caused the ambiguity. A Board of Immigration (BIA) decision did provide a common sense interpretation (Garcia, Maria T, File A79-001-587, June 16, 2006), but this is not binding on the USCIS and we know first hand that the USCIS has not consistently interpreted the provision in accordance with the BIA decision. Second, although the above mentioned BIA decision clarifies the provision also applies to F4 derivative beneficiaries, these petitions do not automatically convert. An F4 derivative beneficiary who ages still must wait for their Parent to file a new I-130 form, which is inconsistent with the language of the provision.
Another problem is if the new proposed points system is implemented, any person who ages out will no longer have a direct basis for immigration. Instead they would have to qualify under a points system, which is not guaranteed. This new system would make the above provisions redundant.

This post is not entirely true.. I have never seen an college(recognized by AICTE) where u will pass only by paying fees.
There are issues in india , but i have seen many people going back , and settling without any problems. The choice to move is more personal , then what could be discussed here ..
I was in India recently for a 2 months vacation, and some work from our Indian office,. First few days were tough , lot of dust , traffic , pollution, But after 2 weeks i was loving it the old way .. and when i was flying back i realized I love Delhi .
If you own a house in the major cities ( ie lot of jobs and business opportunities) then going back makes sense. But if you belong to a small city , and have to move to a bigger city anyway, then living here makes more sense.
The reality (which is bad) is that if you have money in india , your life style is much better than what u have in US (dont forget , even earning 100K, doesn't really make u rich here , Honda and Toyota are poor people's car in US.. I have seen very few EB applicants driving a BMV,Bentley)
When i was in India, i went to best hotels for food (2000Rs buffets) virtually every week.,just went to NY once for a 200$ buffet, in 6 years.
So everyone has to take a personal decision, based on personal factors..
I would agree with most of what you said that it is personal issue and personal choice. if you feel here homesick then better to go home at the earliest.
I toally dis-agree with you in terms of education issue. I am in education field since I was born (as a student and as faculty both in India and US) so I had seen closely both sides of the coins. Our education system in India is detoriating day by day with no quality control on private institutions and no nation wide approach for QUALITY of education. We have made education available to every one (mostly !!) but during that process we have made it to go in to the tank. With few good institutions among the thousands of colleges and universities does not make it good quality. Percentage of below standard education institution are increasing day by day. Each time I go back home and see how the education is detoriating, I feel deeply sorry about state of education in India. Opening college in every village and giving degree to every one who wants does not make good education. In old days we were giving those degrees to only one those deserve it and can earn it. That is why our old mass of graduates was highly acclaimed all over world. Now a days our average scientist and engineers ( I am not talking about all high quality one from population of billion !!) is very poor.
Also just to Add here same AICTE who approves technical colleges in India, Its DIRECTOR in CHIEF was under govt investigation of messive corruption in the approval process of the institutions.
So dont feel so good about CURRENT and FUTURE education system in India, unless we try to improove the QUALITY issue of our technical graduates at put it AHEAD of QUANTITY OF GRADUATES

Have you visited the offices of US Congressmen in DC, and tried to explain our issue to Senators and Congressmen? Yes, I have. I was asked the same question in each and every office - "If half-a-million people are impacted by the backlogs, how come only 3-4 people (idiots like me) visit us with this complaint. Why aren't we visited by our other constituents? Why don't your members even write letters to us?".
This is THE REASON why the movement has not made much headway.
It is always an option for any one with in their org, but if his point is wrong, then IV core leadership should prove him that they are not sitting idle or moving very very slow.

...that u r crying over USCIS issues? Chill dude :). They were gracious enough to realise their mistake last year and hand out EADs to everyone. Full marks to USCIS for being spontaneous and doing the right thing at the right time. Infact its ppl like u who will always keep cribbing no matter what. Even after u get ur GC u will crib over citizenship delays. Shame on u.

I've sent 7001 to Ombudsman , Contacted Congressional offices and ultimately filed a Service request in Nov 1st week. After all this NSC opened my case yesterday Dec 9th and the status changed to "RFE sent" - there you go ! They bought at least 2 months extra time.
What a bunch of jokers at NSC - my case was extremely straight forward :(
