If you have a pending permanent residency application you should still be able to work under h1b status, particularly if your i-140 is approved.

On April 15, 2010, the Department of Homeland Security issued the USCIS �Annual Report on Characteristics of Specialty Occupation Workers (H-1B) for Fiscal Year 2009.� The summary reports on information including the countries of origin, occupations, education levels, and compensation paid to those who had approved H-1B petitions in FY 2009. The report includes the following facts: approximately 48 percent of all H-1B approved workers were born in India; 41 percent were for workers in computer-related occupations; and 41 percent were for workers with a bachelor�s degree and 40 percent had a master�s degree. I am on 6th year and need to extend my h1b. My lawyer informs me that 45day letter from Backlog center is enough for 7th year extension.
I thought we need to get the screen-shot of pending labor as a proof for 7th year extension.
Does anyone got extension based on 45day letter for the 7th year or beyond....???

USCIS has not extended its temporary accommodation for delays in the labor condition application (LCA) process. Earlier, USCIS agreed to accept H-1B petitions without a certified LCA, in certain situations, for a limited time. This exception was available from November 5, 2009 to March 9, 2010. The USCIS has declined to extend this exception. Accordingly, all H-1B petitions must be filed with the certified LCA otherwise USCIS will deny the H-1B petition or extension.
Hence, it again is necessary to have an Approved LCA in place for the proper location at the time of the H-1B filing. The reason the exception was not extended is that the DOL assured USCIS that LCAs are being processed within the required seven-day processing time. The DOL, in fact, stated that LCAs are being processed within four to five days which is in fact true as well. It is our suggestion to plan accordingly.

Here is my scenario;
My ex employer (ABC) applied for my green card in 2006. In 2007, I got my 140 approved and I applied for 485. In 2009, I changed jobs using my EAD. ABC still holds my H-1b. Also, I did not file for AC21 yet.
ABC still owes me close to 25k in back pay. I want to report them to Dept of labor and get my money back. What are my options and what are the ramifications of doing so on my green card process?
Questions
If ABC revoked my 140, what should I do? Can I still renew my EAD and AP and continue with my employment in US? My current company is a fortune 20 company and they will support me with any documentation needed?
Since, ABC still holds my h1b, aren't they liable to pay me till date?

Hi,
I am confused with AP expiration date.
The printed exiration date is :July 29, 2009
But my latest paroled stamp on AP it is : Dec 05, 2009.
Which date should i follow to renew my AP?

Go by original printed exiration date. Someone confused with this . He has to reapply for the green card.
