Did anyone notice that Compete America seem to have changed its website recently? I visited their website after sometime and it seems that they changed it recently.
It is good to see Bill Gates and Eric Schmidt bring the focus back on green card wait times -

Hi
My wife H1B was approved under Consular Processing. She got job offer now and it is a Consulting job to Hire. We applied COS at CSC by Premium processing. Reached application on Sep 28 and Status is Acceptance by then.
1 ) Everything is genuine and in the client letter it is mentioned as 6 Months contract to hire. Are there any posibbilities of getting H1B approved for only 6 months from now.
2 ) Are there any chances of rejection
3) Sincle past week it is under "Acceptance" stage. I know i have to be patient.
4) Can we expect some decision from them this week as client is waiting.
5) At what time CSC updates the case. Is there any particular time they update the case online.

Hi,
I have been doing a lot of research about this online and have even heard from friends that if you transfer your H1 to H4 and apply again for H1, your new H1 application is not counted against the H1B cap. How true is it? Has some one done this before ? Is there any risk involved? Any help would be really appreciated.

Hi All,
I applied for my I485 during the July 07 fiasco and also for EAD/AP for me and my wife. I just renewed my H1B for another 3 years and my manager just said that since I have my H1B, I shouldnt renew my EAD/AP when it expires next year since it is quite an expense for the company. My wife is using her EAD for her current job and so that will still be renewed.
Just wanted to find out if there can be any issues if I dont renew just my EAD/AP?
Also after filing for the I485 in July 07, we did our Fingerprinting in Feb 08. We had not received FP notice and had to go through infopass to get FP done. Since then we've not received a renewal for FP again. I believe FP expires in 18 months and we need get it done again. Should I be receiving FP notice for renewal or do I need to go thru infopass again?

My employer mentioned that my job description is Senior Analyst in the application. Does that mean I have to be a Senior Analyst till the time I get GC ? Cant I take up another job like Architect ?

Hi,
I have applied for my H1B transfer from my current employer to a new company. I have not had any issues with my current employer with pay or anything like that. I have maintained my H1B status with my salary coming on time as promised and have all the paystubs and correct documents. My new employer is a big american MNC and they have hired a well known law firm for transfer process.
My only question is I have not informed my current employer yet and will inform him in a weeks time once my LCA is done and transfer is filled. He will not be very happy about this and I have initially signed an offer letter which says I will work with him for atleast a year and its only been 6 months so far. Can he create any problems in my transfer by cancelling my current H1 or any other problems with my reliving? Pls help.

For a EB2 position, that requires a MS with no alternate qualification accepted:
1. Does the business necessity need to show how the job duties match the course work during MS or why the job duties are needed for the company?
2. Do we need to send the business necessity at the time of applying for PERM or only when audited.

A friend of mine was recently stuck in administrative processing from November till March 13th (he was informed about the approval on March 18th) a total timeframe of 5 months. He reached the US on March 22nd and was admitted on H1 without any issues.
He sent me the following facebook link which list at least 200 such cases of similar souls.
"Here is a link to Facebook group on visa delay the kind I had. There is a spreadsheet which lists a sample of 200 cases since Nov.

Please be aware of it."

I used another 140 based on my regular Labor filed in 2004 and got my GC a
few months back.
Today I got this email regarding the abandoned 140. What does this mean?
