Hi Folks
just got my GC. Now if I contract for a security clearance job, like Armed forces, or Defense related one through the same employer that sponsored by GC, CAN I BE ELIGIBLE for a waiver of the 5 years waiting period -to what extent is is waived ....100% or only part of the 5 years wait, if at all .
My Company is a US Defense Vendor .
Can someone pt me to the right place where all this is clarified.
Also would the same kind of waiver apply if you work for a Govt agency or it is strictly defense...

Hi,
I need some clarification. One of my friend confued me.:confused:
My I-485 is filed (I-140 is already approved) by my lawyer.
I am traveling in Sep end returning in Oct End.
I have my H1-B extension with me and need to get it stamped in India.
As per my lawyer, she will file for EAD and AP after I come back. I am not sure what she ment then about the she has filed my application in July.
As per her there is no issue as she will file my EAD/AP after I come back.
Will this travel be an issue in my stamping in India and/or getting back in the US after stamping?
Please advice.

Hey folks who signed up for advocacy days: I am so proud of you! You signed up for the good of all of us. I heard some of you are not confirming your participation. This cannot be an option at this point!
After all the effort IV has put in in securing the appointments, I, V, We all are counting on you. You had the best intentions when you signed up and we appreciate that, now we need you to finish grad school without being a drop out.
Many hundreds of hours have gone into organizing this event and not having folks at a meeting that has been confirmed is bad PR for IV and disappointing, sad and frustrating for the people who have been working tirelessly. Can't have it, can't tolerate it. You guys must follow through on your commitment!!!!
PM me if you have some pressing issue and maybe we can muster up some help to pull you through..

You are only counted against the quota once for a 6 year period , so I believe, she won't come under the quota , although it's getting harder to get H1B extensions every day

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. My 7th year H1-B renewal was mailed by my lawyer on March 30th to the Vermont Serice Center. They received it on March 31st. I know that there was a change in filing taking effect April 1st. What happened in my case is that the USCIS forwarded my files to the California Service Center without receipting it first. California reveiced my file on April 4th and now I find myself out of status. My lawyer tries to tell me that it was an USCIS mistake whereas a lawyers who I retained for a second opinion tells me it was the mistake of the first attorney. I did everything possible for the to reconsider their decision but I still would like to know who's to blame. If it was indeed the lawyera mistake I'm considering filing a complaint against him.

My H1B was refused under section 221(g) (petitioner is not able or willing to provide employment....) and case has reached USCIS for review. The lawyers however are asking me to travel on H4 and then convert to H1 in US and they say this can be done in 2 weeks. I am so very skeptical about this! How is this even possible?
Their response is that i have an H1B from earlier quota, so i can get a new petition filed and start working on it once its approved.How come people dont do this if its valid?
My questions if anybody can help me are
1) Can i go on H4 visa without revoking my H1B petition which is under review with USCIS? Or will consulate ask me to revoke my H1B petition?
2) If i go on H4, can i really get a COS to H1 in US i.e. not the April 2011 quota but in the already assigned quota and i can start working within a few days of approval?

My PD is Jun 2008 and my I140 is approved in April 2009 in EB2. My employer and lawyer did not give me any paperwork regarding Labor or I140 so I know details about Ad, Job Title or Description and stuff like that. If I want to transfer my H1 and keep the Priority Date, how can I know these details. Will it be a problem if I dont have these details.

Since H1 is for 6 years, you can extend for another year without filing I-140. You can apply for renewal within 180 days before expiry.
