    Check the status using the H1B receipt number usually EACXXXXXX or WACXXXXXX

    If something has changed, The status gets changed.....kinda weird.

    Once you get married and get your License your spouse can file for I-130, I485 concurrently. You can file for EAD and Advance parole also along with this you need affidavit of support I-824

    I see that India got around 27400 Gcs. Does it mean spill over was happening during FY 2007? I was under the impression it started since FY 2008.

    My husband will go to India for long time. I am on H4 in USA. He wants to file H4 to F1. If he is in india, then will I be out of status here ?Do I also have to leave USA with my husband eventhough if my visa change is in progress ? please advise

    I need an advice.

    Last year, I petitioned for my husband to get his green card and I was in a rush to get the application in before the application fee shot up, so I forgot to make copies of all the documents being sent to USCIS. Now, the interview is next week and I don't have a few of the documents that they want us to bring. It says that if already submitted, I don't have to bring in those documents, but I've heard that sometimes the interviewers still demands them during the interview.

    Is there any way of getting the documents from USCIS or is it lost forever?

    We will have the interview next Thursday, 21st of February.

    Background - My wife's immigration timeline
    H1-B 01/2000 to 8/2001
    Moved to O-3 as dependent due to old 6 yr H1-B rule.
    O-3 9/2001 to 5/2006
    Stepped out of the US in May 2006
    The intention was to get a full 6 yr H1-B (decoupling didn't exist)

    Questions while applying for H1-B to reclaim reminder of 6 yrs in H1-B

    1) Can she apply for H1-B while she is in India?
    2) Can she enter the country as my dependant and work on approved H1-B?

    I graduated in Dec 2008 from USA and then returned back India. My F1 visa is valid till dec 2011 and am planning to come back USA for pursuing my phd. I got I20 from a different university. Do I need to attend for f1 visa stamping again ? . Please help .

    If you are having the valid visa, there is no need to go for stamping again. While entering you can show the H1B approval so that you get the I94 till the date on the H1b approval.

    I just got my H1 visa. As my understanding that they will stamp my passport at the port of entry, I wonder if they will keep my current I-797 at the port of entry (I already have the H1 stamp in my passport). Pls advise. Also, I don�t have the bottom portion of the I-94 on I-797 since I am currently in Malaysia . Would this be a problem? Please also advise if they will issue me the new I-94 at the port of entry. Anybody pls help. Thank you very much.

    I am currently studying in the US on an F visa and have managed to loose my passport a couple of months ago. The passport itself is replaced but I hesitated to renew the I-94 since it takes longer time than my duration of status and it is cheaper to just leave the country and send a mail to USCIS later with proof of departure.

    To the problem, I am changing status from F to A. Since the interview is not required I was able to obtain the new visa through mail. Now, I am currently in the US with a valid new visa but no I-94 which means I will be out of status two months after my F visa expires. Being close to the Mexican border my plan is to cross it and come back on the same day to officially get the A status and a new I-94. I will of course send photocopies of all the papers and stamps to USCIS to not fall out of status on the previous visa. Are there any legal problems doing this?

    you should have your I-140 approved to claim your previous PD for future LC.

    Hi,

    What is the best way to save one from going out of status on E-3 visa?Can a E-3 Visa holder or E-3D visa holder may apply and successfully get EB-3 or EB-2 green card?Can E-3 visa holder may work for two employers (already USCIS approved extension petition from both) simultaneously (without filling any new I-129 or extension request)?

    The place of birth for E-3 Visa holder is Pakistan.

    Please suggest and advise?
